TERMS AND CONDITIONS OF USE OF THE LOUVRE HOTELS GROUP WEBSITE

Preamble

LOUVRE HOTELS GROUP makes the website www.louvrehotels.com available to its customers, enabling them to make online bookings, including accommodation bookings, with hotels operated under the brands of LOUVRE HOTELS GROUP and listed on the Website (hereinafter the “Establishment(s)”) (hereinafter the “Website”).
The Website is operated by LOUVRE HOTELS GROUP, a French simplified joint-stock company (société par actions simplifiée), registered with the Nanterre Trade and Companies Register under number 309 071 942, whose registered office is located at Tour Voltaire, 1 Place des Degrés, 92800 Puteaux / La Défense, France (hereinafter “LOUVRE HOTELS”).

1. Acceptance of the terms of use

By using the Website, the User acknowledges that they have read and unreservedly accept these Terms of Use, together with all documents referred to herein, including the Privacy and Personal Data Protection Policy and the Cookie Policy. These documents may be viewed, saved and printed by the Customer from the footer menu of the Website.

2. Definitions

The terms defined below, beginning with a capital letter and used in the singular or plural, shall have the following meanings:

“Customer” means any person making a Booking for one or more rooms in an Establishment for personal or professional purposes, excluding any natural or legal person booking overnight stays on behalf of third parties or for resale.

“Account” means the personal area made available to a User on the Website following registration in accordance with the conditions set out in these Terms of Use. The Account is strictly personal, individual, non-assignable and non-transferable to any third party. The Account is accessed using the User’s login credentials and contains certain User Data. Creation of the Account entails enrolment in the Radisson Rewards loyalty programme, established and managed exclusively by Radisson, of which the User is informed when creating the Account.

“Data” means information relating to the User, including Personal Data, provided directly or indirectly by that User, in particular when creating an Account, making a Booking or accessing the Website. The User warrants to LOUVRE HOTELS that the information provided is accurate and up to date, in particular as regards identity and contact details.

“Personal Data” means, within the meaning of Article 2 of the French Data Protection Act (Loi Informatique et Libertés), “any information relating to an identified natural person or a natural person who may be identified, directly or indirectly, by reference to an identification number or to one or more factors specific to that person”, and, within the meaning of Article 4 of Regulation (EU) 2016/679, “any information relating to an identified or identifiable natural person (‘data subject’); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier, or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person”. Personal Data includes, in particular, data relating to Users of the Website that enables them to be identified.

“Customer Area” means the interface reserved for Users holding an Account, protected by a login and password. The Customer Area enables the User to use the Services.

“Offer” means the list of accommodation options generated on the basis of the Establishments available on the Website in response to a request made by the User, including, in particular, for each option: a description of the Establishment, a presentation and the specific features of each room, the applicable rate and the cancellation conditions.

“Radisson Rewards Loyalty Program” means the loyalty program established and managed exclusively by Radisson. LOUVRE HOTELS GROUP is a participating entity in the Radisson Rewards Loyalty Program. As such, customers of the Establishments may join the Radisson Rewards Loyalty Program in order to benefit from advantages within the Establishments, subject to the terms, conditions and limitations set out in the General Terms and Conditions of the Radisson Rewards Loyalty Program, which are available from the footer menu of the Website.

“Booking” means the action by which the User reserves one or more Offer(s) through the Website, under the conditions set out in the General Terms and Conditions of Sale.

“Services” means all actions and functionalities offered by LOUVRE HOTELS through the Website under the conditions and within the limits set out in the Terms of Use. Certain Services are available only to Users holding an Account.

“User” means any natural person accessing the Website, whether as a mere visitor or as a Customer.

3. Purpose

These Terms and Conditions of Use, together with the documents to which they refer, set out the terms, conditions, rights, obligations, liabilities and limitations applicable to any use of the Website by any User (hereinafter the “Terms of Use”).

4. Availability of the website

The User acknowledges and accepts that, given the current state of technology, LOUVRE HOTELS cannot guarantee continuous availability of the Services or of the Website.
LOUVRE HOTELS shall use its best endeavors to make the Website continuously available, except in the event of maintenance or update operations, or where events beyond its control cause interruptions to all or part of the Services or disruptions of varying significance. In such cases, LOUVRE HOTELS shall take the reasonable measures available to it to address such interruptions or disruptions

5. Conditions for access to the customer area

Access to and use of the Customer Area by Users is conditional upon the User creating an Account. If LOUVRE HOTELS accepts the creation of the Account, the User may access their Account using their login and password.
When creating the Account, the User must provide the requested information. The User undertakes to provide accurate, truthful, complete and up-to-date information, in particular as regards their identity and contact details. If all information requested when creating the Account is not provided completely and truthfully, LOUVRE HOTELS may refuse to create the Account.

The following fields are mandatory for the creation of the Account:

  • First name;
  • Last name;
  • Email address;
  • Country;
  • Country/province code;
  • Telephone number;
  • Password.
  • By clicking “Sign up”, the User joins the Radisson Rewards Loyalty Programme and accepts its General Terms and Conditions, which may be accessed via the relevant redirection link.

LOUVRE HOTELS recommends that Users configure their password as follows: at least 8 characters and four different types of characters (one uppercase letter, one lowercase letter, one digit and one special character).
Forms containing incomplete or incorrect data shall not be taken into account.
The User is responsible for the accuracy of the data entered and must inform LOUVRE HOTELS, as soon as possible, of any change to such data.
Once registration has been confirmed, the User may access their Customer Area.
The User may update or amend their data or delete their account from their Customer Area, under the “My Profile” section.

6. Blocking of access to the account

If the User forgets the password for their Account, they may reset it. To reset the password, the User must select the “Forgotten password” link available on the Website and enter the Account identifier. An email will then be sent to the email address provided by the User when creating the Account, setting out the steps to be followed in order to reset the password.

7. Description of the services

7.1 The Services offered by LOUVRE HOTELS on the Website enable Users:

  • To use the online booking service for the Establishments marketed on the Website, under the conditions set out in the General Terms and Conditions of Sale (GTCS), and to manage their Bookings.
  • To benefit from commercial offers proposed by LOUVRE HOTELS, including seminars, events, sports groups and promotional offers, in accordance with the general terms and conditions of sale specific to such offers, available either on the Website or directly from the Establishments participating in such commercial offers.
  • To enroll in the Radisson Rewards Loyalty Program.

7.2 Customer Area services: From their Customer Area, Users holding an Account may use the following Services:

  • Managing and viewing their Bookings.
  • Setting their preferences: in particular, they may subscribe to newsletters or select their favorite brands.
  • Viewing information relating to the Radisson Rewards Loyalty Program of which they are members.
  • Viewing special offers marketed on the Website.
  • Managing, updating or amending their personal information.
  • Deleting their Account.

8. Technical Intermediary

In accordance with LOUVRE HOTELS’ GTCS, which may be consulted on the Website, the Offers and information communicated by LOUVRE HOTELS are based on data and information transmitted by the Establishments. The User acknowledges and accepts that LOUVRE HOTELS, in its capacity as a technical service provider, exercises no control over such data and information and, consequently, cannot verify or guarantee the accuracy, lawfulness, legality, security, quality or completeness of the Offers, information, data and content transmitted by the Establishments and made available on the Website.
Similarly, in its capacity as a technical intermediary, LOUVRE HOTELS exercises no control over, and does not monitor or validate, Bookings made within the Establishments.
If LOUVRE HOTELS becomes aware that any content is unlawful, it reserves the right, at its sole discretion, to remove such content immediately from the Website.
Users are invited to notify LOUVRE HOTELS of any fraudulent use of the Website of which they become aware, and in particular of any content that may breach the prohibitions set out in the Terms of Use or, more generally, applicable laws and regulations.

9. Conduct

Each User must use the Website responsibly, with respect and courtesy towards the rights of LOUVRE HOTELS and of any third party.
By accessing the Website, the User undertakes and warrants in particular that they shall: 

  • have the required capacity and skills to use the Website;
  • act in accordance with, and comply with, all provisions of these Terms of Use; 
  • comply with all applicable laws, including those of the country from which the Website is accessed;
  • provide accurate, complete and up-to-date data;
  • respect the intellectual property rights of LOUVRE HOTELS and of any third parties;
  • use the Website within the limits of its functionalities and intended purpose.

Furthermore, the User is prohibited, in particular, from:

  • using the functionalities of the Website for purposes not provided for in the Terms of Use or in the GTCS, or in a manner contrary to the intended purpose of the Website and/or likely to infringe the rights of LOUVRE HOTELS, any of its partners, the Establishments or any third party;
  • using a false identity or otherwise misleading any person;
  • providing LOUVRE HOTELS with false, misappropriated or incorrect contact details and information; or uploading to the Website, displaying, making available or transmitting by any means, including by email, any content that the User is not entitled to upload, display, make available or transmit;
  • illegal, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene or immoral content, content infringing a person’s privacy, or content that is hateful, derogatory or shocking, in particular from a racial, ethnic or other standpoint; 
  • any element containing software viruses or other computer code, files or programs designed to interrupt, destroy or limit the functionality of any software, hardware or telecommunications equipment; 
  • disrupting or interrupting the operation of the Website or the servers or networks connected to the Website, or breaching any applicable requirements, procedures, rules or regulations;
  • accessing Personal Data not intended for them or entering a server that the User is not authorized to access; 
  • attempting to probe, scan or test the vulnerability of any system, in particular the Website, or to breach any security or authentication measures without authorization; 
  • impersonating or attempting to impersonate another User or any third party; 
  • harming any natural or legal person through the Website;
  • damaging the reputation of LOUVRE HOTELS, the Establishments, the Website, one or more other Users or any third party. 
The User also undertakes not to disclose any personal, professional or confidential information disseminated through the Website, of which they may become aware through use of the Website, or originating from third parties.
A fortiori, the User shall refrain from any processing of Personal Data obtained on or through the Website, including any collection, unauthorized or improper use, and any act likely to infringe the privacy, Personal Data or reputation of one or more other User(s) or of any other natural or legal person.

10. Intellectual property rights

The Website, including all elements of which it is composed, in particular developments, graphics, images, photographs, animations, videos, texts, logos, software and interfaces (hereinafter the “Content”), is protected by intellectual property rights and is the exclusive property of LOUVRE HOTELS, except for trademarks, logos, images, photographs and distinctive signs belonging to third-party companies or other third parties.
Any use, including any reproduction, distribution, modification, retransmission or publication of the Content, is strictly prohibited without the prior written consent of LOUVRE HOTELS.
In particular, it is prohibited to (i) copy, modify, create a derivative work from, assemble, de-compile (except as permitted by law), sell, assign, sub-license or transfer in any manner whatsoever any right relating to the Content, and (ii) modify all or part of the Content, in particular with a view to obtaining unauthorized access to the Website.
Consequently, any total or partial reproduction and/or representation of the Content without the prior written authorization of LOUVRE HOTELS is prohibited and may constitute infringement, punishable in particular under the provisions of the French Intellectual Property Code.
LOUVRE HOTELS, or any other holder of such rights, may take any measure or action, including legal proceedings, to put an end to any infringement of its rights, in particular its intellectual property rights, and reserves the right to claim damages in the event of such infringement.

11. Cookies

Cookies are data stored on an internet user’s terminal equipment and used by LOUVRE HOTELS GROUP to send information to the internet user’s browser, enabling that browser to return information to the originating website.
LOUVRE HOTELS uses cookies and specifies which cookies are used. In this respect, the User may consult the Cookie Policy accessible from the menu in the footer of the Website.
The User has a right of access, rectification and objection in respect of their Personal Data communicated through cookies.
The User’s browser settings enable the User to be informed of the presence of cookies, to refuse them or to configure them according to the type of cookie concerned.
However, the User is informed that certain functionalities of the Website may no longer be available if they refuse the installation of such cookies.

12. Hyperlinks

Any creation of links to the Website, any framing of the Website and, more generally, any use of any element forming part of the Website is subject to the prior written authorization of LOUVRE HOTELS, which may be revoked at any time at its sole discretion.
LOUVRE HOTELS shall not be liable in any way for the content of websites to which hyperlinks may redirect the User.

13. Liability

The User acknowledges that they use the Website under their sole responsibility. In particular, the User is responsible for protecting themselves against the risks inherent in the Internet and for taking all necessary measures to protect their own data, including their Personal Data, and/or software against contamination by any viruses that may affect their computer or any other computer equipment used by them or under their control.
The User is solely responsible for the means of accessing the Internet and the Website.
Except with respect to Data, LOUVRE HOTELS endeavours, to the best of its ability, to ensure the accuracy of the information accessible on the Website, but does not warrant that the information provided by the Establishments or by any other third party is accurate, complete or up to date.
Furthermore, LOUVRE HOTELS disclaims any liability in the event of any interruption of the Website, malfunction or damage resulting from fraudulent acts by third parties or Users.
In addition, under no circumstances may LOUVRE HOTELS be held liable for any damage whatsoever, irrespective of its cause, origin, nature or consequences, arising in particular from any use of the Website by the User that does not comply with these Terms of Use or from consultation or use of the Website by any third party.
LOUVRE HOTELS shall not be liable where the event giving rise to liability results from an event of force majeure, including where such force majeure event affects one of its subcontractors, or from any event outside its exclusive control.
Moreover, LOUVRE HOTELS informs the User that it reserves the right, at any time and for any reason whatsoever, to implement any measures enabling it to suspend or delete access to all or part of the Website, without prior notice, in particular in the event of any conduct, whether identified or suspected, that breaches all or part of the Terms of Use, including the Privacy Policy, whether expressly or impliedly, without prejudice to any damages that LOUVRE HOTELS reserves the right to claim from the User as compensation for the loss suffered.

14. Amendments of the terms of use

The Terms of Use may be updated by LOUVRE HOTELS. The previous version of the Terms of Use shall then be automatically terminated and replaced by the new version, which shall be immediately enforceable against the User and shall state the date of the latest update indicated at the beginning of the Terms of Use. In order to be informed of any amendments or updates, the User is advised to consult the Terms of Use regularly.

15. Survival

The provisions of the Terms of Use which, by their nature or wording, are intended to continue to apply after termination of use of the Website for any reason whatsoever, as well as the provisions of the “Liability” and “Intellectual Property Rights” sections, shall remain in force for the period necessary to fulfil their purpose.

16. Severability - Headings

If one or more provisions of the Terms of Use are held to be invalid or are declared invalid pursuant to a law, regulation or final decision of a competent court, the remaining provisions shall remain in full force and effect.
In the event of any difficulty of interpretation between any heading appearing at the beginning of a clause and the relevant clause itself, the heading shall be disregarded and the content of the relevant clause shall prevail.

17. Governing law and jurisdiction

These Terms of Use and the documents to which they refer shall be governed by French law.

In the event of a dispute, the User undertakes first to contact LOUVRE HOTELS in order to attempt to resolve amicably any dispute that may arise in connection with the Terms of Use.
Failing an amicable agreement within 30 days following the letter initiating the request for amicable settlement, any dispute relating to the existence, interpretation, performance or termination of the Terms of Use, including in the event of multiple defendants, shall be submitted, unless exclusive jurisdiction is granted to another court, in particular the Paris Judicial Court (Tribunal judiciaire de Paris) in intellectual property matters, to:
1. in the event of a dispute with a trader: the Paris Commercial Court;
2. in the event of a dispute with a non-trader: the territorially competent French court.
